These Terms of Service describe the rules for using tubnexa.com and the TubNexa AI-assisted YouTube thumbnail creation and analysis application. By creating an account or using the service, you agree to these terms.
1. Using TubNexa
TubNexa helps creators develop thumbnail concepts, generate images, enhance prompts, and analyze visual directions. AI output is a creative aid, not a guarantee of clicks, views, revenue, ranking, or audience performance.
2. Your account
You are responsible for providing accurate account information, keeping access to your authentication methods secure, and all activity under your account. Do not create an account or use the service if you are not legally able to agree to these terms.
3. Your content
You keep ownership of the prompts, reference images, and other content you submit, subject to the rights needed by TubNexa and its service providers to operate the requested features. You confirm that you have permission to upload and process any image, face reference, logo, or other material you submit.
4. AI output and third-party rights
You are responsible for reviewing generated images and confirming that your intended use does not infringe copyright, trademark, publicity, privacy, or other rights. Do not ask TubNexa to imitate a living creator in a way that misleads viewers or violates rights. You should obtain appropriate permissions before publishing people, brands, or copyrighted material.
5. Acceptable use
- Do not use TubNexa for illegal, fraudulent, abusive, deceptive, or harmful activity.
- Do not upload malware, private information belonging to another person, or content you do not have permission to process.
- Do not bypass usage limits, scrape the service, reverse engineer it, or interfere with its operation.
- Do not use generated content to impersonate, defame, harass, or deceive another person.
6. Plans, limits, and payments
TubNexa currently offers monthly Starter, Creator, and Studio plans as shown on the pricing page. Paid subscriptions renew monthly until canceled. Credits are limited by the selected plan, reset at the start of a new billing period, and do not carry over unless the pricing page expressly says otherwise. You may cancel before the next renewal through the payment provider. Except where required by law or approved by support, payments are non-refundable. If a paid generation fails after a credit is consumed, we may restore that credit when the failure is confirmed. Taxes, payment-provider terms, and the final amount shown at checkout apply to each purchase.
7. Availability and changes
We may change, suspend, or discontinue features, models, limits, or integrations. We do not promise uninterrupted availability or that AI-generated results will always be accurate, unique, or suitable for a particular purpose.
8. Intellectual property
TubNexa’s brand, interface, code, and service materials belong to the service operator or its licensors. These terms do not grant you a right to copy, resell, or exploit those materials except as allowed by law.
9. Suspension and termination
We may suspend or terminate access when necessary to protect the service, comply with law, enforce these terms, address abuse, or respond to non-payment. You may stop using the service at any time and request account or content deletion by contacting support@tubnexa.com. Termination does not remove payment obligations already incurred or rights that should continue by their nature.
10. Disclaimers and liability
The service and AI output are provided on an “as available” basis. We do not guarantee uninterrupted availability, a particular result, originality, accuracy, click-through rate, views, revenue, ranking, or audience performance. You are responsible for reviewing every output before publication and for confirming that it complies with applicable law and third-party rights. To the extent permitted by law, TubNexa is not responsible for indirect, incidental, special, consequential, or lost-profit losses resulting from use of the service.
11. Changes to these terms
We may update these terms as TubNexa changes. Continued use after the updated date means you accept the revised terms where permitted by law. Material changes should be communicated through the service or another reasonable notice channel.
12. Governing law and contact
These terms are intended to be governed by the laws of Morocco, without regard to conflict-of-law rules. Subject to any mandatory consumer protections, disputes should be brought before the competent courts of Casablanca, Morocco. For questions about these terms, contact support@tubnexa.com.
